Kissing A Spouse While Fasting

Question

If a person kissed his wife in Ramadhaan and he had completely forgotten at the time that swallowing the saliva of a spouse will break his fast.

Did his fast break and should he do kaffarah?

Answer

His fast is nullified and Kaffarah will be necessary. Not remembering the Mas’ala at the time of swallowing the saliva will not change the ruling.
