Question

Do the children of a deceased son, inherit from their father’s mother when she passes away? She leaves behind one daughter and no other children. What is the Shari’ee ruling?

Answer

We understand from your query that a lady passes away leaving behind a daughter and her late son’s children. These are the only heirs to her estate. In the queried scenario, the late son’s children will inherit from their paternal grandmother’s estate, together with their paternal aunt. For detailed calculations and shares, a list of the heirs should be sent to us.
