Selling clothing with pictures on it

Question

Is it permissible to sell material or clothing with prints of animate objects on them?

Answer

If the picture on the clothing or material is the objective of the purchaser, then selling such material or clothing will not be permitted. In this instance, the income derived will be Makrooh-e-Tahreemi. However, if the picture is not the objective, then selling the material or clothing will be permitted. (اشترى ثورا أو فرسا من خزف لأجل استئناس الصبي لا يصح) ولا قيمة له (فلا يضمن متلفه، وقيل بخلافه) يصح ويضمن قنية، وفي آخر حظر المجتبى عن أبي يوسف: يجوز بيع اللعبة وأن يلعب بها الصبيان(الدر المختارج7ص478)

(قوله من خزف) أي طين: قيد به لأنها لو كانت من خشب أو صفر جاز اتفاقا فيما يظهر لإمكان الانتفاع بها(الدر المختار ج5ص226)

و كذ بطل مع مال غير متقوم كالخمر و الخنزير…..و يدخل فيه فرس او ثور من خزف لاستئناس الصبي لانه لا قيمة له و لا يضمن متلفة (الدر المنتقي ج2ص54)
