Discharging Sadaqah of Jinaayat in places outside of Makkah Mukarramah

Question

If one had perpetrated one of the prohibitions of Ihraam which necessitated Sadaqah, where should the Sadaqah be discharged?

Answer

The Sadaqah can be given anywhere as it is not necessary to discharge it in Makkah Mukarramah. However, it would be more virtuous to give it to the poor people in the Haram of Makkah Sharif but not necessary.

دم وغیرہ واجب ہوتو حرم شریف میں ذبح کرنے کا حکم :

سوال : اگر حج میں دم یا صدقہ کفارہ وغیرہ جو واجب ہوتا ہے تو اس کو کہاں ادا کرے؟ حرم میں بھیجنا ضروری ہے یا باہربھی کرسکتا ہے؟

الجواب : صورت مسئولہ میں ہدی کا جانور چاہے وہ شکرانہ کی ہدی ہو یا جنایت کی حدود حرم میں ذبح کرناضروری ہے، پس ہدایا کا حدود حرم کے علاوہ کسی اور جگہ ذبح کرنا جائز نہیں ہے ہاں صدقہ میں اختیار ہے لیکن حرم کے مساکین پر خرچ کرنا افضل ہے ۔

وفـيـه أيـضـاً: ولا يشترط في التصدق به أي بلحمه عدد المساكين … ولا فقراء الحرم فلو تصدق به على غيرهم أي غير فقراء الحرم…جاز وفقراء الحرم أفضل، أي مطلقاً. (لباب المناسك مع شرحه:(435
