Wife Giving Without The Husband’s Permission

Question

A wife gives away things from the house without her husband’s permission. She even gives away his personal possessions! Is there any Hadith to prove that it is impermissible to do so?

Answer

It is not permissible for a wife to give a gift (or items from her husband’s home, including food) without his consent. [Re: Fataawa Uthmaaniyyah Vol:10 Pg:418]

Abdullah ibn ‘Amr narrates that Rasulullah Sallallahu Alaihi Wasallam said, “It is not permissible for a woman to give anything except with her husband’s consent.”

«لا يجوزُ لامرأة عَطِيَّة إِلا بإِذن زوجِها» . عبد الله بن عمرو بن العاص: أَنَّ رسولَ اللهِ ﷺ قال

عَنْ أَبِي أُمَامَةَ قَالَ: سَمِعْتُ رَسُولَ اللَّهِ – صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ – يَقُولُ فِي خُطْبَةِ عَامِ حَجَّةِ الْوَدَاعِ) بِفَتْحِ الْوَاوِ وَتُكْسَرُ ” لَا تُنْفِقُ ” نَفْيٌ وَقِيلَ: نَهْيٌ، فِي الْمَصَابِيحِ: أَلَا لَا تُنْفِقُ ” امْرَأَةٌ شَيْئًا مِنْ بَيْتِ زَوْجِهَا إِلَّا بِإِذْنِ زَوْجِهَا ” أَيْ صَرِيحًا أَوْ دَلَالَةً (قِيلَ: يَا رَسُولَ اللَّهِ وَلَا الطَّعَامَ؟ قَالَ: ” ذَلِكَ “) أَيِ الطَّعَامُ ” أَفْضَلُ أَمْوَالِنَا ” أَيْ أَنْفُسِنَا، وَفِي نُسْخَةٍ أَمْوَالِ النَّاسِ، يَعْنِي فَإِذَا لَمْ تَجُزِ الصَّدَقَةُ بِمَا هُوَ أَقَلُّ قَدْرًا مِنَ الطَّعَامِ بِغَيْرِ إِذْنِ الزَّوْجِ، فَكَيْفَ تَجُوزُ بِالطَّعَامِ الَّذِي هُوَ أَفْضَلُ (رَوَاهُ التِّرْمِذِيُّ)
