Question

After the ghusl of the mayet is complete, is it permissible to take the body to the house before the janazah salaah takes place? Is this considered delaying the janazah?

If it is permissible please explain why in reference to the following hadith ;

Ali bin Abi Talib (RA) narrated that:

The Messenger of Allah (SAW) said to him: “O Ali! Three are not to be delayed: Salat when it is due, the funeral when it is presented, and (marriage) for the single woman when someone compatible is found.”

Answer

As salām ʿalaikum wa raḥmatullāhī wa barakātuhu

In the Name of Allāh, the Most Gracious, the Most Merciful.

The Fuqahā’ have strongly emphasised the importance of hastening the Janāzah Ṣalāh, based on several Aḥādīth, including the one mentioned in your query. This emphasis is such that it is even permissible to perform the Janāzah Ṣalāh during the Makrūh times of Ṣalāh, such as after Fajr or ʿAṣr.

For the smooth arrangement of the Ghusl, Janāzah Ṣalāh, and burial, it is the common practice of today to stipulate a specific time for it soon after the person’s passing. If after the Ghusl, some time remains for the stipulated Janāzah Ṣalāh time, then it is permissible to bring the body back to the house for that time.

It should be noted that when stipulating a time for the Janāzah Ṣalāh and burial, one should avoid setting an unnecessarily delayed time. Sufficient time should be allowed to ensure that the Ghusl can be completed with ease.

However, it would be Makrūh to fix the Ṣalāh time by factoring in additional time to take the body home, as this constitutes an unnecessary delay.

And Allāh Taʿālā knows best.
