Question

What are the Shar’ee requirements for the nikaah to be valid?

Answer

It is a condition for the nikaah to be valid that the proposal and acceptance take place between the bride and bridegroom, or their representatives in the presence of two Muslim baaligh male witnesses, or one Muslim baaligh male witness and two Muslim baaligh female witnesses.

ويندب إعلانه وتقديم خطبة وكونه في مسجد يوم جمعة بعاقد رشيد وشهود عدول … (وينعقد) ملتبسا (بإيجاب) من أحدهما (وقبول) من الآخر … ومن شرائط الإيجاب والقبول اتحاد المجلس لو حاضرين … (وشرط سماع كل من العاقدين لفظ الآخر) ليتحقق رضاهما (و) شرط (حضور) شاهدين (حرين) أو حر وحرتين (مكلفين سامعين قولهما معا) على الأصح (فاهمين) أنه نكاح على المذهب بحر (مسلمين لنكاح مسلمة ولو فاسقين أو محدودين في قذف أو أعميين أو ابني الزوجين أو ابني أحدهما وإن لم يثبت النكاح بهما) بالابنين (الدر المختار 3 /8-23)

وأما شروطه … ومنها الشهادة قال عامة العلماء: إنها شرط جواز النكاح هكذا في البدائع وشرط في الشاهد أربعة أمور الحرية والعقل والبلوغ والإسلام … ويصح بشهادة الفاسقين والأعميين كذا في فتاوى قاضي خان … ويشترط العدد فلا ينعقد النكاح بشاهد واحد هكذا في البدائع ولا يشترط وصف الذكورة حتى ينعقد بحضور رجل وامرأتين كذا في الهداية ولا ينعقد بشهادة المرأة ينبغي رجل وكذا الخنثيين إذا لم يكن معهما رجل هكذا في فتاوى قاضي خان ومنها سماع الشاهدين كلامهما معا هكذا في فتح القدير (الفتاوى الهندية 296-295 /1)
