Gifting the house to the wife

Question

A man passed away leaving behind a wife and six children. In his lifetime, he contributed monthly towards a retirement fund, and whilst alive, he had written and signed that he had made his wife 100 % benefactor of this fund. In addition, he had a house in which his wife and children live. In his lifetime, he mentioned to his wife that 'this house is for you'. Does this fund and house form part of the inheritance to be distributed?

Answer

If the transfer of the house was made to the wife in his lifetime when he was not ill, then the house belongs to the wife. If he had been contributing voluntarily to the fund, then the amount that he contributed should be divided among his heirs proportionate to their shares. The heirs should give the additional amount in charity without the intention of receiving any reward.

وقال في النهاية قال بعض مشايخنا كسب المغنية كالمغصوب لم يحل أخذه وعلى هذا قالوا لو مات الرجل وكسبه من بيع الباذق أو الظلم أو أخذ الرشوة يتورع الورثة ولا يأخذون منه شيئا وهو أولى بهم ويردونها على أربابها إن عرفوهم وإلا تصدقوا بها لأن سبيل الكسب الخبيث التصدق إذا تعذر الرد على صاحبه اهـ (رد المحتار 6/ 385)

سئلت فيمن يملك نصابا من حرام هل تجب عليه فيه الزكاة الجواب لا تجب عليه فيه الزكاة بل يلزمه التصدق بجميعه على الفقراء لا بنية الثواب إن لم يكن صاحب المال موجودا (الفتاوى الكاملية صـ 15)

قال شيخنا ويستفاد من كتب مشايخنا كالهداية وغيرها أن من ملك بملك خبيث ولم يمكنه الرد إلى المالك فسبيله التصدق على الفقراء... والظاهر أن المتصدق بمثله ينبغي أن ينوي به فراغ ذمته ولا يرجو به المثوبة (معارف السنن 1/ 34)
