Household Items Being Distributed In Inheritance

Question

A lady passed away. How will her household effects belonging to her be distributed?

Answer

All personal household effects form part of the estate as well. A value should be attached to these items and then they may be distributed amongst the heirs by mutual agreement or sold to a particular heir or a potential buyer and the monies accrued from the sale should be distributed amongst the heirs according to the percentages they inherit from the estate.

Alternatively the procedure of ‘Takharuj’ could be implemented where an heir could take a certain item, the lounge suite for example and waive his rights in the remainder of the items. By doing so, the particular heir becomes the owner of the lounge suite whilst the rights of the remaining heirs drop off from the lounge suite. Such a transaction falls in the category of ‘Sulah’ which in simple terms is reaching a mutual agreement or compromise in a particular matter or dispute.
