Tying Ihraam from Jeddah

Question

A family went for Umrah and stayed first in jeddah. The next day after Asr they left for Makkah shareef to perform Umrah and tied ihraam in Jeddah. Was this correct and if not what is the ruling?

Answer

If their destination was Jeddah (i.e. The intention at the time of commencing the safar was to stay in Jeddah), then it will be permissible for them to enter Jeddah without Ihraam and there will be no damm upon them.

And Allah Ta'ala knows best.

( وحرم تأخير الإحرام عنها ) كلها ( لمن ) أي لآفاقي ( قصد دخول مكة ) يعني الحرم ( ولو لحاجة ) غير الحج أما لو قصد موضعا من الحل كخليص وجدة حل له مجاوزته بلا إحرام فإذا حل به التحق بأهله فله دخول مكة بلا إحرام وهو الحيلة لمريد ذلك إلا لمأمور بالحج للمخالفة ( لا ) يحرم ( التقديم ) للإحرام ( عليها ) بل هو الأفضل إن في أشهر الحج وأمن على نفسه ( وحل لأهل داخلها ) يعني لك لمن وجد في داخل المواقيت ( دخول مكة غير محرم ) ما لم يرد نسكا للحرج كما لو جاوزها حطابو مكة فهذا ( ميقاته الحل ) الذي بين المواقيت والحرم ( و ) الميقات ( لمن بمكة ) يعني من بداخل الحرم ( للحج الحرم وللعمر الحل ) ليتحقق نوع سفر.
