Wali ke beghair nikaah karna

Question

Kiya baghair wali ke nikaah hojata hai? Court marriage jaiz hai ya na jaiz?

Answer

Shariat ka hukm he ke larki apna nikaah khud na karaai balke us ka wali us ka nikaah karaai. Agar larki wali ke beghair apna nikaah khud karaai, to ye bohot hee be hayaai ka kaam he. Baz aimma (jeise Imaam Shaafiee aur Imaam Ahmad) ke yaha larki ka nikaah wali ke beghair nahi hoga. Leikin Hanafi mazhab me masala ye he ke agar larki wali ke beghair apna nikaah khud karaai to dekha jaaye ke agar larka us ka kuf he ya nahi. Agar larka us ka kuf he, nikaah hojaayega aur agar larka us ka kuf nahi he, nikaah nahi hoga.
