Muqeem reading qasr salaah thinking he was a musaafir

Question

If one thought he was musaafir and read two rakaats for his namaaz, but after that he found out that he was not a musaafir, then what must one do? Should one repeat his namaaz?

Answer

If he was not a musaafir, then he needed to perform four rakaats. Since he only performed two rakaats, the fardh did not take place. He will have to repeat his fardh as four rakaats. If the time has elapsed, he will have to perform it as qadha.

وذكر في العيون أنه إذا صلى العشاء فظن بعد ركعتين أنها ترويحة فسلم أو صلى الظهر وهو يظن أنه يصلي الجمعة أو يظن أنه مسافر فسلم على رأس الركعتين أنه يستقبل العشاء والظهر (بدائع الصنائع 1/223)

قال - رحمه الله - (توهم مصلي الظهر أنه أتمها فسلم، ثم علم أنه صلى ركعتين أتمها وسجد للسهو) أي أتم الظهر أربعا وسجد للسهو لما روي أنه - عليه الصلاة والسلام - فعل كذلك في حديث ذي اليدين عن أبي هريرة، ولأن السلام ساهيا لا يبطل صلاته لكونه دعاء من وجه بخلاف ما إذا سلم على ظن أنه مسافر، وعلى ظن أنها جمعة أو كان قريب العهد بالإسلام فظن أن فرض الظهر ركعتان أو كان في صلاة العشاء فظن أنها التراويح حيث تبطل صلاته في هذه المسائل؛ لأنه سلم عامدا - والله أعلم – (تبيين الحقائق شرح كنز الدقائق 1/199)

وحديث رفع عن أمتي الخطأ محمول على رفع الإثم وحديث ذي اليدين منسوخ بحديث مسلم إن صلاتنا هذه لا يصلح فيها شيء من كلام الناس (إلا السلام ساهيا) للتحليل: أي للخروج من الصلاة (قبل إتمامها على ظن إكمالها) فلا يفسد (بخلاف السلام على إنسان) للتحية، أو على ظن أنها ترويحة مثلا، أو سلم قائما في غير جنازة (فإنه يفسدها) مطلقا

قال ابن عابدين – رحمه الله تعالى - (قوله إنها ترويحة مثلا) أي بأن كان يصلي العشاء فظن أنها التراويح؛ ومثله ما لو صلى ركعتين من الظهر فسلم على ظن أنه مسافر أو أنها جمعة أو فجر (قوله أو سلم قائما) أي على ظن أنه أتم الصلاة بحر (قوله فإنه يفسدها) أي في الصور الثلاث؛ (رد المحتار 1/615)
